Terms of Service
Last Updated: February 27, 2026
Welcome to The Better Yoo. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Waseem Khan operating as The Better Yoo ("Company," "we," "us," or "our"). By accessing our website or enrolling in one of our coaching programs — the Longevity Audit, Flagship Coaching, or Executive VIP (collectively, the "Services" or "Protocol"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use our services.
Section 01
Service Description & Practitioner Status
Waseem Khan provides services as a private Performance Consultant and High-Performance Coach. While Waseem Khan holds a Master of Exercise Physiology (M.Ex.Phys), he is not providing services as an Accredited Exercise Physiologist (AEP) under the Exercise & Sports Science Australia (ESSA) framework within the context of this coaching relationship.
Nature of Service
The Protocol is an educational and performance coaching service designed for healthy individuals seeking optimization. It is not a clinical or medical treatment service. The Protocol is delivered exclusively via digital means; no in-person physical assessment or manual therapy is performed.
No Medicare / Insurance
The Protocol does not participate in Medicare, private health insurance, or any rebate schemes.
No Clinical Relationship
Participation in this program does not establish a clinician-patient relationship. The relationship is solely that of a coach and a client.
Section 02
Medical Disclaimer & Informed Consent
IMPORTANT: THIS IS NOT A SUBSTITUTE FOR MEDICAL ADVICE.
The information, recommendations, and materials provided by The Better Yoo are for general informational and performance optimization purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Pre-Program Medical Clearance
You acknowledge that it is your sole responsibility to consult with a licensed physician or other qualified health care professional ("Medical Provider") prior to commencing the Protocol. This is especially important if you:
- have a pre-existing medical condition (including but not limited to heart conditions, diabetes, high/low blood pressure, or chronic pain)
- are pregnant or nursing
- are over the age of 35
- have been sedentary for an extended period
Cardiovascular Acknowledgement
Client specifically acknowledges that high-intensity protocols may place stress on the cardiovascular system and warrants that they have no known heart conditions.
Voluntary Participation
You acknowledge that participation in exercise, nutritional changes, and lifestyle protocols involves inherent risks, including the risk of physical injury, musculoskeletal discomfort, or other health complications. You voluntarily assume all risks associated with your participation.
Biomarker & Lab Review
Client agrees that any review of biomarkers, blood panels, or lab assays provided during the Services is purely educational. The Company does not diagnose deficiencies, diseases, or medical conditions, and all observations must be verified by the Client's primary Medical Provider before altering any medication or medical treatment.
Self-Monitoring
You are responsible for monitoring your own condition during the Protocol. You agree to immediately stop any activity that causes pain, discomfort, or distress and to seek medical advice from your Medical Provider. Client warrants that their physical training environment is safe, clear of hazards, and that they will not attempt any movement or load during a virtual consultation or video submission that exceeds their current safe physical capacity.
Section 03
Client Responsibilities
The success of the Protocol relies on your active participation and honesty.
Accuracy of Disclosure
You agree to provide a complete and accurate health history and information regarding your current physical status. Failure to disclose relevant medical history may increase your risk of injury.
Personal Accountability
You are solely responsible for your own choices and actions during the Protocol. You agree to use your best judgment and scale any recommendations to your current fitness level.
Section 04
No Guarantees of Specific Outcomes
You acknowledge that The Better Yoo provides education and coaching based on evidence-based science. However, individual results vary significantly based on adherence, genetics, nutrition, sleep, stress, and lifestyle factors. You agree that Waseem Khan and The Better Yoo do not guarantee specific results, including but not limited to specific weight loss, muscle gain, or pain resolution within a specific timeframe.
Section 05
Fees, Payment, and Refund Policy
Investment
The fees for the Protocol are as specified on our website or enrollment agreement. All fees are non-transferable.
Payment Terms
Full payment is required in advance to secure your enrollment and access to the Protocol materials.
Refunds
Cancellation Prior to Start
If you cancel your enrollment prior to the official start date of the Protocol, you may be eligible for a refund minus a reasonable administrative fee.
Cancellation After Start
Due to the immediate access to digital intellectual property and the customized nature of the coaching services, we do not offer refunds or credits for any partial use of the Protocol once it has commenced.
Medical Withdrawal
If a medical issue arises that prevents you from completing the Protocol, you must provide written documentation from your Medical Provider. In such cases, we will review the situation on a case-by-case basis and may offer a partial credit toward a future program at our sole discretion.
Section 06
Intellectual Property Rights
All content provided by The Better Yoo, including but not limited to workout protocols, mobile applications, videos, checklists, guides, spreadsheets, and written communications, is the sole and exclusive intellectual property of Waseem Khan.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to access the materials for your personal, non-commercial use only.
Restrictions
You agree not to share, copy, reproduce, sell, trade, resell, or distribute any of our materials to any third party without our explicit written consent.
Section 07
Limitation of Liability
To the maximum extent permitted by Australian Consumer Law and applicable international laws:
AS-IS Basis
The services and materials are provided on an "AS IS" and "AS AVAILABLE" basis.
Exclusion of Damages
In no event shall Waseem Khan or The Better Yoo be liable to you or any third party for any indirect, punitive, incidental, special, or consequential damages arising out of or in connection with your participation in the Protocol.
Cap on Liability
Our total liability to you for any claim arising out of these Terms or your participation shall not exceed the total amount you paid to us for the Protocol during the thirty (30) days immediately preceding the event giving rise to the liability. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, this limitation may not apply to you.
Section 08
Indemnification
You agree to defend, indemnify, and hold harmless Waseem Khan and The Better Yoo, its employees, contractors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- your use of and access to the Protocol
- your violation of any term of these Terms
- your violation of any third-party right, including without limitation any physical injury or property damage
- your failure to seek medical advice as recommended herein
Section 09
Data Privacy
Your privacy is important to us. Our collection and use of your personal information (including sensitive health information) is governed by our Privacy Policy. By using our services, you consent to the collection and use of your data as outlined in that policy.
Section 10
Dispute Resolution & Governing Law
Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of laws provisions.
Dispute Resolution
In the event of a dispute arising out of or relating to these Terms or the Protocol, you agree to first attempt to resolve the dispute informally by contacting us directly. If the dispute cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the courts located in Sydney, New South Wales to resolve any legal dispute.
Section 11
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Section 12
Entire Agreement
These Terms constitute the entire agreement between you and The Better Yoo regarding your use of the service, superseding any prior agreements between you and us relating to your use of this service.
Section 13
